• General trading terms
The site is the property of Simply Necessaries in its entirety, aswell as all rights connected to it. Any reproduction, full or partial, necessits the authorization of the owners. However, hypertext links to the site are allowed without specific requests. 1. Acceptance of Terms The customer acknowledges having read, at the time of the order, the conditions of sale stated on this screen and expressly declares to accept them without reservation. All orders placed to Simply Necessaries are for the personal use of client. Clients or product recipients refrain from any sale and any total or partial reproduction of the products. These general conditions of sale govern the contractual relationship between Simply Necessaries and its clients, both parties accepting them without reservation. These terms and conditions shall prevail over any other conditions contained in any other document, unless previously agreed in writing. 2. Products The photographs illustrating the products are not contractual. If errors occur, in no case shall the liability of Simply Necessaries can be initiated. All products offered to its customers by Simply Necessaries are available today or under mentionned delay (information is given about delay of availability). Simply Necessaries undertakes to deliver articles without defective workmanship or defects. 3. Ordering The automatic registration systems are considered as proof of the nature, content and date of the order. Simply Necessaries confirms its acceptance of the purchase order to the supplied email address. The sale will only be concluded on confirmation of the order. Simply Necessaries reserves the right to refuse any order from a customer with whom there is a dispute concerning payment of a previous order. All information given by the buyer, when taking a sales contract, are his (her) responsability: should any error in the name or address occur, the seller can not be held responsible for any impossibility in delivering the product. 4. Delivery After confirmation of the order, Simply Necessaries undertakes to deliver to its carrier, "La Poste (the french post office), all items ordered by the purchaser within a maximum period of 72 hours (3 working days), no shipping on weekends. For deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of goods, customs duties, value added taxes and other fees payable under the laws of the country receiving the command. Simply Necessaries cannot be held legally responsible if the payment of taxes was not made by the client. Delivery will be made by mail in France and abroad. Delivery is made in the customers mailbox. Neither Simply Necessaries or "La Poste" can not be held responsible once the delivery in mailbox has been made. Are considered as "force majeure", relieving the seller of its obligation to deliver : war, riot, fire, strikes, accidents and the impossibility of being supplied. Always check that your order is complete on arrival of your package. If the customer wants to order with 2 different places of delivery, he (she) must pass 2 separate orders, each with the costs of delivery. The charges, calculated by the weight of the order and its packaging, vary depending on the country of delivery: Areas and delivery time :
Prices are expressed in euros (€) Zone countries Dom-Tom: Guadeloupe, French Guyana, Martinique, Reunion, Mayotte, Saint Barthelemy, Saint Pierre and Miquelon and Saint Martin. Retractation You have 7 days (after receipt of the items) to retract and request a refund of the order. Refund will be made within a maximum period of 30 days after receipt of returned items. 6. Non-conformity In case of non-conformity of the ordered product (s), you have 48 hours to make any claims with Simply Necessaries in case of a missing product or damage which would not be related to transportation. In the event there is a deterioration declared within 48h after receiving the order, Simply Necessaries will refund all sums paid by the customer and the cost of returning the product. Reimbursement will be within a maximum period of 30 days from receipt of returned items. Any damage to a product shall not entitle the customer to "claim damages". In any case, the client receives the legal guarantee on eviction and hidden defects (Art.1625 and following of the French Civil Code). On condition that the purchaser makes the proof of hidden defect, the seller must legally repair all the consequences (art.1641 and following of the Civil Code). Price All prices are in Euro (€) with an indication in franc (FF). The price on the product does not include shipping. The price stated in the confirmation of the order is the final price, all taxes included, incl. VAT (Value Added Tax) in France and EEC countries. This final price includes the price of products, packing and shipping. 8. Payment The price charged to the customer is the price indicated on the order confirmation sent by Simply Necessaries. Total payment is made by card bearing the initials CB, via the secure PayPal, or by check (FRANCE only) made payable to Simply Necessaries and sent to: Simply Necessaries 69 bd Alsace Lorraine 64100 Bayonne France The shipping of the order will only be made upon receipt of payment. Online, PayPal allows you to pay via a bank in a secure environment (https service). Your credit card number is directed to the PayPal server, your payment is made directly to Paypal in a secure environment without going through the server of the shop, ensuring even more important security as your card numbers are known only to our partner bank (PayPal). The order validated by the customer shall be considered effective only when the bank payment centers have given their agreement. Warranty Simply Necessaries guarantees that all selected products are manufactured by craftsmen in France. 11.
